Changes to the "Construction Act"
The Local Democracy, Economic Development & Construction Act was given Royal Assent on 12th November 2009 – it will be known as the LDEDC Act 2009. It will bring into force changes to the Housing Grants (Construction and Regeneration) Act 1996, better known as the Construction Act, both in relation to payment and dispute resolution provisions. However, no date has been set for the new Act to come into force and it is not likely to be for some time since the detailed changes to the old Scheme for Construction Contracts (which sets out the default position on payment timescales and dispute resolution where parties fail to specify otherwise in their contracts) have yet to be finalised. We will keep you updated on its progress.
